1. Acceptance of Terms

By accessing the website at perristreeservice.com or by requesting, scheduling, or receiving any service from Perris Tree Service ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms may be updated at any time, and continued use of our website or services constitutes acceptance of any changes.

2. Description of Services

Perris Tree Service provides residential and commercial tree care services, including but not limited to tree removal, tree trimming, tree pruning, stump grinding, stump removal, land clearing, emergency tree service, and commercial tree service. Services are available in Perris, CA and surrounding communities in Riverside County. Service availability and scope are determined at our discretion based on the specific conditions of each job site.

3. Estimates and Pricing

All estimates provided by Perris Tree Service are based on conditions observed at the time of the on-site assessment and are valid for 30 days from the date of issuance unless otherwise noted. Estimates are not final contracts. Final pricing may change if:

• Site conditions differ materially from what was observed at the time of the estimate
• Additional work is discovered or requested during the course of the job
• Access to the work area is more restricted than anticipated
• Required permits result in additional fees

We will notify you of any material change in price before proceeding with additional work. Written quotes, when provided, represent our best assessment of the total cost based on available information.

4. Scheduling and Cancellation

Once a service date is confirmed, we ask for at least 24 hours advance notice if you need to reschedule or cancel. Jobs cancelled with less than 24 hours notice may be subject to a cancellation fee to cover crew scheduling costs. We reserve the right to reschedule jobs due to weather conditions, equipment issues, or other factors outside our control. We will notify you as early as possible if we need to reschedule and will work with you to find the next available date.

5. Customer Responsibilities

Before work begins, the customer is responsible for:

• Clearing the work area of vehicles, furniture, pets, and other items that could be damaged or that could impede the crew
• Disclosing the location of underground utilities, irrigation lines, and any known hazards on the property
• Obtaining any required permits unless we have agreed in writing to handle the permit process
• Ensuring that access to the work area - including gates, fences, and pathways - is available to the crew on the scheduled day

6. Payment Terms

Payment is due upon completion of each job unless other arrangements have been agreed to in writing in advance. We accept payment by cash, check, or electronic transfer. For larger projects, we may require a deposit before work begins, which will be specified in the written estimate. Invoices not paid within 30 days of the completion date may be subject to a late fee of 1.5% per month on the unpaid balance.

7. Permits and Compliance

Certain tree work may require permits from the City of Perris, Riverside County, or other governing authorities. Where we have agreed in writing to obtain permits on your behalf, we will do so as part of our service. Where permit responsibility rests with the property owner, we will advise you of the requirement, but ultimate compliance is your responsibility. We are not liable for fines, delays, or other consequences arising from unpermitted work where we were not engaged to manage the permitting process.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Perris Tree Service shall not be liable for:

• Indirect, incidental, or consequential damages arising from our services or inability to perform services
• Damage to underground utilities, irrigation systems, or structures not disclosed to us before work began
• Damage to trees, plants, or property outside the agreed scope of work
• Loss of use, lost profits, or other economic losses

Our total liability for any claim arising from a specific job shall not exceed the amount paid for that job. Some states do not allow the limitation of certain damages, so some of the above limitations may not apply to you.

9. Warranty Disclaimer

Tree care work is performed on living biological material, and outcomes cannot be guaranteed. We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. We do not warrant that trimming, pruning, or any other treatment will prevent future tree failure, disease, pest infestation, storm damage, or other natural events. All work is performed without warranty for any specific tree health outcome beyond the work itself.

10. Dispute Resolution

We are committed to addressing legitimate concerns in good faith. If a dispute cannot be resolved informally, the parties agree to pursue mediation before initiating any legal action. Any unresolved disputes shall be subject to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in Riverside County, CA.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions. Any legal action not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Riverside County, California.

12. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. We encourage you to review these terms periodically. Your continued use of our website or services after any changes are posted constitutes your acceptance of the updated terms.
